The agency is required to provide the basics for sanitation in the workplace. The specific requirements are found in OSHA Standard 29 CFR § 1926.
29 CFR § 1926.51(a)(2) An adequate supply of potable water shall be provided in all places of employment.
Where employees are exposed to hot weather, the water must be cool. For many years the FAA, and apparently other agencies, have balked at providing bottled water at remote facilities. They cite a Comptroller General of the United States decision, B-303920, saying that bottled water is a personal expense. As a general rule, appropriated funds may not be used for personal expenses.
However, OSHA requires that potable water be provided as a mater of health
at all workplaces. This means bottled water is not necessarily a personal expense if it is the only source of potable water for the site. This is the case at many FAA facilities.
One alternative for providing drinking water is to do so in large water jugs. However, this is often not practicable. The Comptroller General of the United States affirmed that it is proper for agencies to purchase bottled water for employees to meet OSHA safety and health requirements in decision B-310502, February 4, 2008.
If you're required to work at sites with no potable water available within a reasonable distance of the site, please contact your local PASS Contract Representative or OSHECCOM member immediately.
